Partner (Migrant) Visa (100)

The Partner (Migrant) (100) visa is the second stage visa that allows you to stay in Australia permanently as the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen. By this stage you would already be living in Australia with your spouse or de facto partner on the 309 visa.  

You will become eligible to lodge the second stage partner visa application (100) if one of the events below occurs:

• at least two years have passed since the date you lodged the 309 visa application; OR
• your Australia partner and sponsor has died; OR
• you have suffered family violence perpetrated by your sponsor.

Relationship

If it has been at least two years At the time of assessment, you and your spouse (if married) or de facto partner must:

• have remained in a mutually exclusive relationship since the lodgment of the initial partner visa application (309)
• be in a genuine and continuing relationship
• either live together, or live apart but only on a temporary basis.

The documentary requirements for a Partner (Migrant)(100 visa include the following:

Identity and other documents

These documents would include birth certificate, passport, national ID, evidence of name changes, proof of address and evidence of any previous relationships etc. Even though some of these documents would have been submitted with the first stage application and would be on the same file used for the first stage assessment, these should be submitted again. There may be changes in some documents such as a new passport or a proof of new address in Australia.

Evidence of relationship

This documentation will be required again with the 100 application to demonstrate that your relationship with your partner is still genuine and continuing. These documents typically fall into four categories collectively known as ‘four-pillars’:

• financial aspects of the relationship
• the nature of the household of the couple
• social aspects of the relationship
• the nature of the parties’ commitment to each other.

Although the Partner (Migrant) (100) and Partner (Provisional) (309) applications are lodged separately around two years apart, a single visa fee applies to both applications and is payable when the 309 visa application is lodged. The fee is legally associated with the 100 visa and as at 1 July 2024, is as below:

• primary applicant – A$ 9,095 
• dependent over 18 years of age – A$ 4,550
• dependent under 18 years of age – A$ 2,280

In addition, there may be fees associated with obtaining police clearances or undertaking medical examinations if requested by the case officer.
