Who is visa 838 for?

This is a permanent visa that may be suitable for you if you are an older person, are single and are financially reliant on a relative living in Australia. If you are currently overseas then you will not be able to apply for this visa. You should instead consider the Aged Dependent Relative Visa (114) .

What are visa 838 requirements

As the visa applicant, you:

Australian relative and sponsor

The relative who is sponsoring your visa application is:

  • an Australian citizen, permanent resident or eligible New Zealand citizen
  • your partner, child, parent, brother, sister, stepchild, step-parent, stepbrother, stepsister, grandparent, grandchild, aunt, uncle, niece or nephew

What documents will I need?

At the current time, Other Family Visa applications cannot be lodged via ImmiAccount and must be lodged as a paper application. The documents required for the Aged Dependent Relative Visa (838) can be grouped under the following categories:

Forms

Some forms such as a Form 80, sponsorship form and Form 956A may be required in addition to the paper visa application

Identity and other documents

These documents would include birth certificate, passport, national ID, evidence of name changes, proof of address and evidence of any previous relationships etc. 

Other documents

These documents would include:

  • documents to demonstrate your relationship with your sponsoring relative
  • evidence of residence status of your sponsoring parent
  • evidence of your dependency on your sponsoring relative.

Fees and charges

As at 1 July 2024, the Home Affairs fees for this visa are as below:

  • primary applicant – A$ 5,125
  • dependent over 18 years of age – A$ 2,565
  • dependent under 18 years of age – A$ 1,285

In addition, there will be fees associated with undertaking health examination and obtaining police clearance (if required).
